  • Rescission: A party involved in a business arrangement may rescind the contract on grounds of mutual mistake, fraud, or lack of capacity or reason. In such instances, a party may request that all monies paid be refunded and the contract rescinded.
  • Reformation: The court may reform a contract to reflect the parties’ true intentions. However, before the courts make this order, specific requirements may have to be met. For example, you may seek reformation of the contract on grounds of a mutual mistake regarding the terms of the agreement.
  • Mechanic’s lien: A lien is often used by construction business partners to secure the payment for services rendered or goods supplied. For example, when a contractor performs their obligations under the agreement, yet the property owner refuses to make payment, the contractor may exercise a lien over some assets belonging to the owner until the debt is paid. However, you may be required to meet established legal requirements to enforce a lien.
  • Damages: Damages are one of the most common remedies that a successful party may obtain through business litigation. There are various types of damages, including compensatory, punitive, nominal, and liquidated damages. Each of these types serves a unique purpose, so it helps to consult a business dispute attorney to evaluate your case before proceeding to court.
