Construction Contracts
Having a properly written construction contract is the best way to avoid costly and time consuming legal disputes. The construction law attorneys at Calabrese Law Associates represent construction companies, general contractors, sub-contractors, and property owners in a variety of construction law related matters. In a majority of these cases, the failure to have a properly written construction agreement is what gave rise to the dispute. To avoid these disputes, our firm prepares construction agreements for clients that conform with Massachusetts law, protect our clients’ interest, clearly identify the scope of the work to be done, the contract price, the procedure for implementing “change orders,” and also provides clients with a change order form that they should use each time a change is made to the scope of work and/or price.

Site Inspections and Permitting
Site inspections by local government agencies (for example, The City of Boston Inspectional Services Department) is a mechanism designed to promote compliance with local zoning regulations and the building code. The most common instance that triggers the need for a site inspection is where a property owner files an application with their city or town seeking to change the legal use and/or occupancy of their property. After such an application is submitted, the city or town will schedule an inspector to visit the property. During the site inspection, the inspector will determine whether the proposed change of use and/or occupancy is possible, whether renovation work must to be done to allow for the change being sought, or whether the proposed change will simply be denied. If renovation work is needed the property owner will need to secure the appropriate building permits. The real estate lawyers at Calabrese Law Associates possess the expertise and experience its clients need to successfully navigate the complex process of seeking to change the use and occupancy of their property.

Appeal of Admin Agency Decisions
Calabrese Law Associates leverages its appeals litigation expertise and government/regulatory practice to effectively represent clients’ through the complicated process of appealing an administrative agency decision. Administrative agencies, which are agencies of the state and federal government, are becoming more common and powerful with each passing day. These government agencies often times have “rule” making authority and they use this authority to implement regulations that control specific sectors of society. This web of regulations overlap with the state law and federal law, creating a situation where, generally, a person/business cannot appeal a government agency decision to a court of law unless (1) the government agency issues a final decision and (2) the person/business appeals of the decision with the agency itself. Generally, only after all inter-agency appeal options are exhausted may a person/business file an appeal with a court of law.

General Contractor Termination

I hired Peter Calabrese to help me terminate a General Contractor who was working on my home, but performing sub-par work. With Peter’s help I was able to terminate the contract quickly and move on with my renovations. He was a pleasure to work with, readily available, and knowledgeable. I would recommend him to friends and family.

I was owed many thousands of dollars by a property developer that wouldn’t pay for my construction services. Peter successfully used the mechanics liens laws to secure my payment and ultimately collected all monies I was owed without having to file a lawsuit. Great job!

I was having issues with my neighbor polluting my property. I called Calabrese Law Associates and spoke with a lawyer immediately. The firm wrote my neighbor a letter demanding that they stop polluting my property and that the debris be cleaned up. The case went to litigation and I was able to recover my costs to clean up the polluting debris, loss in property value, plus other losses I suffered. Amazing lawyers and I plan to use them again in the future!

Thank you for resolving the problems I was having with my contractor and for recovering the money I have now spent to correct the contractor’s mistakes! When the contractor stopped working on the new addition to my home I did not know what to do, especially after realizing that he had done the work completely wrong. Calabrese Law and its lawyers contacted the contractor and demanded a refund of my monies. The contractor did not respond at first but after the firm filed a breach of contract claim for me and won, the contractor was forced to refund my money plus interest! I highly recommend Calabrese Law Associates. Thanks again!

I was involved in a multi-party and multi-count litigation involving various complex construction, real estate, and contract issues. I had worked with numerous lawyers in the past but was not satisfied with their performance. I retained Attorney Calabrese as my trial counsel shortly before my scheduled trial date and he was able to quickly review decades-worth of documentation and prepare a compelling case. The trial lasted many days and throughout that process Attorney Calabrese absolutely delivered the best possible result for me! I would like to mention that Peter is very easy to talk to and he values his client’s opinions and remains focused on his client’s goals.
